Does an employee of JSC “Ukrzaliznytsia” have to familiarize himself with a copy of the decision of the Company’s Management Board against signature?

The Union of Railroad and Transport Builders of Ukraine is appealing to the Union about the facts of forcing employees to familiarize themselves with a copy of the decision of the Board of JSC Ukrzaliznytsia of June 27, 2024 against their signature. (excerpt from the minutes of the meeting No. Ts-82/39 Kom.t) on some issues of regulating the payment of financial assistance for health improvement during the period of martial law.

The trade union informs that such demands from the employer are ILLEGAL. Employees have no obligation to familiarize themselves with copies of board resolutions against signature, as no legislative or local regulations provide for this.

According to para. 1.2 by the decision of the Management Board of JSC “Ukrzaliznytsia” dated 27.06.2024, which was not agreed with the trade union, health care benefits will be paid upon applications of employees in accordance with the orders of JSC “Ukrzaliznytsia”, regional branches, branches, their structural units, and NOT IN ACCORDANCE WITH THE DECISION OF THE MANAGEMENT BOARD.

Forcing employees to familiarize themselves with a copy of this decision against their signature is intended to prevent further requests from employees to recover arrears of health improvement benefits for 2024.

The employee has the right to refuse to familiarize himself with a copy of the said decision of the Management Board.
